These Terms and Conditions apply to You as a client placing online orders (hereinafter referred to as “You” or the“User” or the “Client”).

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, WE ADVISE YOU NOT TO ACCESS AND/OR USE THE ONLINE ORDERING APPLICATION (HEREINAFTER REFERRED TO AS “THE APPLICATION”). BY ACCESSING AND/OR USING THE ONLINE ORDERING APPLICATION YOU SIGNIFY THAT YOU ACCEPT THESE TERMS AND CONDITIONS.

Subject to applicable legal regulations, We may, at our sole discretion, at any time, modify or otherwise change the Terms and Conditions of Use. We recommend that you read these Terms and Conditions carefully each time you place an order online, as they may affect your rights.

These Terms and Conditions describe the general terms and conditions for placing online orders between Us and You, as well as the various rights and obligations of the Parties.

For the avoidance of doubt, these Terms and Conditions apply (also) to online ordering through the application (hereinafter referred to as the “online ordering application” or “the application”; the applications being the online ordering application used by the Customer to place an order for various products and/or services (hereinafter referred to as the “products” and/or the “services”).

The online ordering application is owned and operated by the holder of the license agreement regarding the use of the online ordering application.
Without prejudice to the generality of the Terms and Conditions set out below and for the avoidance of doubt, you must also comply with the license agreement in order to use the online ordering application.

The Restaurant will make every effort to ensure that the information regarding online ordering is correct and secure. However, it cannot be foolproof and sometimes errors may occur. You should take appropriate steps to verify all information relating to online ordering before using it. To the fullest extent permitted under applicable law, the Restaurant disclaims any representations and warranties of any kind, whether express or implied, as to any aspect of online ordering including but not limited to the availability of the online ordering application.

The Restaurant may revise, at any time, the information relating to the online ordering application and/or the online ordering process and reserves the right to make such changes without obligation to notify past, current or prospective customers. In no event shall the Restaurant be liable for any indirect, special, incidental or consequential damages arising from the use of any of the information contained herein and/or in connection with the online ordering process.

By placing an order online, You acknowledge and agree that use of the application and/or the online ordering process is at Your own risk and to the fullest extent permitted by applicable law and in no event shall We be liable for any direct, indirect, incidental, special, consequential or punitive damages, losses, costs or expenses, or lost profits, resulting from the use of or inability to use this online ordering application and/or any application and/or material on any site linked to this online ordering application (including, but not limited to, viruses or other bugs, defects or malfunctions of computer transmissions or network communications), even if We have been advised of the possibility of such problems. In addition, We do not accept any responsibility for changes to the content of the online ordering application and/or the online ordering process by unauthorized third parties. All express or implied representations or warranties are excluded to the fullest extent permitted by applicable law.

The online ordering application and/or the online ordering process may contain content, information or links to third parties or third party websites. The Restaurant is not responsible for the content of such web pages or the content of any third party promotion or sponsorship or compliance with these regulations. Links may be accessed at the user’s own risk and the Restaurant makes no representation or warranty regarding the content, completeness or accuracy of such links or web pages that refer to this online ordering application. You agree to indemnify and hold the Restaurant harmless from any and all liability arising from your use of information originating from third parties or your use of any third party website.

Unless expressly stated, all information relating to the online ordering application (including but not limited to images, buttons, and text) is proprietary and/or made available with the permission of the holder of the license agreement regarding the use of the online ordering application and the rights of use thereof and cannot be copied, distributed, or reproduced or transmitted in any form or by any means, electronic, mechanical, photocopying, recording or otherwise, without the prior written permission of the Restaurant.

The content relating to specific products (e.g. food items), arrangement and appearance of texts on the online ordering application and/or the online ordering process, the trademarks, and any other content are proprietary and are protected according with the applicable legal regulations and cannot be used in any way without the express written consent of the Restaurant.
The Client does not obtain any license or right in relation to the information relating to the online ordering and/or application.

If you decide to order online using the online ordering application, you will be required to provide full contact details and/or create an account and you may be required to accept cookies. You must keep your details confidential and must not disclose them to anyone. The Restaurant reserves the right to suspend your use of the online ordering application and/or the online ordering process if you breach the Terms and Conditions.

You acknowledge and agree that all orders are treated as an express intention to purchase the listed products and/or services for the agreed online prices and We treat this as a firm offer from you to purchase such products and services. Any modifications must be made in writing otherwise they will not be binding on either party.

Acceptance of any order for any of the products and/or services shall be entirely at the discretion of the Restaurant. Acceptance of an order by Us may occur when you receive an on-screen message and/or email notification and/or SMS confirmation of your order.

The Restaurant reserves the right to refuse any service, terminate your access to the online ordering application and/or the online ordering process, remove or edit any content or accept your orders in its sole discretion and without prior notice.
The Restaurant’s online ordering application must only be used by persons over the age of 18 (eighteen) years, or the minimum legal age permitted by the law or otherwise under the supervision of an adult or guardian.

Any products and/or services provided through the online ordering application are done so on an “as is” and “if available” basis and the Restaurant expressly excludes any warranties, conditions, representations or other terms relating to the online ordering application or the content or products displayed on it, whether express or implied, unless expressly stated otherwise.

Images of products are for presentation only. Ordered products may differ (e.g. colour, shape, etc.) from the photos available on the website. The Restaurant is not responsible in any way if the description of the Products is not complete.

Delivery orders are also subject to the following conditions: i) Your address is part of the defined delivery area of ​​the Restaurant; ii) The online availability of the Restaurant to accept online orders; iii) Your order may be subject to a minimum order condition;
You can pay using any of the methods listed on our check-out screen. Please ensure that if you place your order using a credit or debit card, the card is valid on the date the order is placed. The Restaurant is unable to refund money from orders paid online. Please contact us directly to resolve any dispute relating to any payment or refund request.

You may be automatically directed to an online listing which refers to the physical location of the Restaurant nearest to You. Please note that prices, minimum amount restrictions and maximum cash restrictions vary from location to location. In addition, if you order online, the price charged may be different to the price of the Products had they been ordered in-store or by telephone.

The online order once placed cannot be modified or cancelled either through the website or offline by calling the restaurant. In any case, if you wish to cancel or complain about your order, please call the nearest physical restaurant location, details of which are included in the confirmatory e-mail sent to you upon placing your order and We will endeavour to assist you.

We will make every effort to provide you with the products you have ordered as close as possible to your requested delivery/collection time but we cannot guarantee, in all cases, the exact delivery time. Delivery time may be affected by adverse weather or traffic conditions. This way we can protect the safety of our couriers. The delivery service may be temporarily suspended in selected areas due to bad weather or unforeseen circumstances.

The Customer agrees to accept delivery of the Products at the agreed time and place of delivery. If you have chosen for the Products to be delivered, the Restaurant will deliver the order to the main entrance of the delivery address but any deliveries carried into the delivery address will only be made if the driver and you agree to this. If you are not present to take delivery of the products at the address given in your order, then We will not refund you the price paid for your order and will charge you for the full value of your order.

The risk relating to the Products shall pass to the Customer upon delivery. Any software service/software program is used and/or downloaded at your own risk. If you are in any doubt as to whether the software service/software program to be used and/or downloaded is suitable for your computer, we recommend that you seek specialist advice before using and/or downloading it.

You are responsible for keeping your personal data, password and payment details confidential. You agree to accept full responsibility for all your activities in relation with online ordering (application).

You may not assign, sublicense or otherwise transfer your rights under these Terms and Conditions. If any provision of this Agreement is and/or becomes invalid, illegal, ineffective or unenforceable, this shall not affect the validity or enforceability of the other contractual provisions, which shall continue to be valid and produce legal effects as if the invalid, illegal, ineffective or unenforceable provision had not been part of this agreement.

The Terms and Conditions do not affect your legal rights.

The Restaurant’s trademarks, as well as the trademarks of other persons but also their related properties are protected against copying and simulation according to national and international laws and cannot be reproduced or copied without the express written consent of the Restaurant.

To the fullest extent permitted by law, the Restaurant excludes all liability arising out of its supply of the Products and in particular shall not be responsible for any loss or damage resulting, directly or indirectly, from or in connection with delay beyond the estimated delivery or pickup time; any situation beyond the Restaurant’s control in terms of consequences and which the Restaurant could not avoid by the exercise of reasonable care or any indirect or unforeseeable loss suffered or incurred by the Client or other parties. In any event, the Restaurant’s liability to the Client shall not exceed the total price charged for the relevant products and/or services.

These Terms and Conditions shall be governed by and construed in accordance with the laws in force in the country in which the Restaurant is headquartered and the Restaurant and any dispute arising out of or in connection with them shall be settled by the competent courts having jurisdiction over the headquarter of the Restaurant, excluding the possibility of conflict of laws.
